Mr. Khaled Hussain developed Post Traumatic Stress Disorder 4 and a half years ago due to a personal injury. Some works were being carried quite a distant from where he was stood and suddenly a defective crane, whereby the boulder of the crane fell off, hurled past our clients face missing by him inches. Mr Farooq Hussain tripped over a pothole nearly three years ago. Birmingham City Council initially denied liability and then went on to concede liability. Claimant: Male client, aged 52 at date of accident; 57 at date of settlement.

Brief Synopsis: The claimant suffered from significant injury to his upper and lower neck.

Description: On 13th August 2003 the Claimant was in the course of his employment as a warehouse assistant at the Defendant’s premises when a colleague threw a roll of carpet approximately 20 feet weighing approximately 125 kg from the top level of the warehouse, striking the Claimant.

The Claimant, a 57 year old man, sustained significant injury to his upper and lower neck, the right lower back and right upper back, the right scapula and side and back of his head. An MRI scan showed mild degenerative changes and he had no significant pre-existing symptoms.

Liability was admitted.

Prognosis: At 5 years post accident, the Claimant and Defendant’s experts met for a supplementary joint statement. It was thought that significant recovery was unlikely. The experts agreed this was not a case of advancement or acceleration. Pre-existing degenerative changes were likely to continue and advance with the normal ageing process.
Following a round table settlement conference, the matter was settled out of court for a total of £65,000. There was no particular breakdown of damages.

Claimant: Male Client, aged 50 years at time of the accident, 54 at the time of settlement.

Brief Synopsis: The claimant suffered from significant injury to his chest requiring a thorocotomy.

Description: The Claimant, was injured whilst in the course of his employment with the Defendant in November 2003.when a coil struck him on the chest causing him to sustain significant injury to his chest and a pain condition. Following this, the Claimant continued to experience persistent chest wall pain around the region of the scar which the Claimant’s expert considered to be a well recognised consequence of the procedure. The experts considered the breathlessness. The Claimant’s expert considered that 20% was as a result of COPD and that this was due to the Claimant being a smoker from a young age. The Defendant’s experts considered it was wholly related to the Claimant having smoked since a young age.
Liability agreed in favour of the Claimant on an 85/15 split.
Pain Management reports were obtained for both parties supporting that the Claimant suffered a chest wall injury and the pain was attributable to the accident.
Prognosis: the Claimant’s pain management expert was of the opinion that the Claimant would be unable to return to work in his former role and would have difficulties in a sedentary role.

Out of Court settlement: approximately £85,000 gross.

Brief Synopsis: The Claimantsuffered serious injury to his right hand as a result of an accident at work – defective machinery.

Description: The claimant suffered from severe amputation to his right hand with complete
detachment of all his fingers and thumb. The claimant had to go through an emergency
surgery to replant his fingers and thumb. Following attendance with several medical experts,
reports were procured and despite the Defendant’s Insurers denying liability for the accident,
we were successful in settling the case at £300,000.00 – total damages (out of Court
settlement).

Claimant: Male Client

Brief Synopsis: The Claimant suffered serious neck injury and psychological injury

Description: The claimant suffered from serious neck injury and psychological injury as a
result of a Road Traffic Accident. The client stopped his vehicle to adjust his fog lights in
front of his vehicle. A third party drove into the rear of his vehicle causing him to be hit by his
vehicle and pushed forward.  He suffered soft tissue injuries to his neck, shoulders and back,
wedge compression to his back, multiples lacerations, fracture of the lower jaw, three lower
incisors loose, depressive episode and post traumatic stress disorder. The case was
successfully settled at £95,000.00 gross in full and final settlement before the trial.

Claimant: Male Client

Brief Synopsis:  The claimant suffered from soft tissue injury to the neck and back.

Description:  The claimant was a passenger in a friend’s vehicle which was involved in a 4
car pile, whereby the claimant was in the first vehicle. The client’s vehicle was stationary at a
set of traffic lights and behind him were two other cars stationary when the fourth vehicle
collided into the rear of the third vehicle. Finally our client’s vehicle was shunted from behind.
The client suffered pain in his neck and lower back. The claimant fully recovered from his
injuries 4 months post accident. A typical valuation for his claim is within the region between

£750.00 to £1,200.00. However, we were successful in doubling the client’s compensation.

Claimant: Female Client

Brief Synopsis: The claimant suffered from soft tissue injury to her knees, neck and elbow.

Description:  The claimant was travelling on a public bus sustained injury when the bus
driver was driving at high speed and suddenly without any warning braked. The bus
company had no record of this incident ever taking place but were prepared to deal with the
case on strict proof of the client’s injuries. The examining expert confirmed that the client
sustained soft tissue injury to her knees, neck and elbow which required further treatment.
This was an out of court of settlement.

Brief Synopsis: The claimant was assaulted by a group of youths.

Description:  The claimant at the age of 25 was physically assaulted by a group of youths in 2006 who were asking for money from the client. The client was attacked and left injured on the street. The claimant rushed to the hospital sustaining cracked jaw, spilt eye requiring stitches. Post incident the client faced mental trauma and fear to go out after the attack but after a long period of time the client has now recovered from his injuries.

Brief Synopsis: The Claimant lost her mother in an arson attack.

Description: The claimant was only 8 years old when she lost her mother, grandparents and her aunt in an arson attack at home in 2004. This case was investigated as a murder case by the police as this attack was a deliberate attack on a large family where 4 members of the family died and only one survivor left. The claimant also suffered from severe burns. We were able to settle the case for £18,000.00.

Brief Synopsis:  The claimant suffered from injury arising out of a dispensing (prescription) error.
Description:  The claimant suffered from physical and psychological injury having taken the wrong tablets. Claim was pursued via Pharmacists’ Professional Indemnity Limited and primary liability was admitted. Accordingly, medical evidence was obtained from various medical experts. Due to the impending limitation date (3 years from the date of the incident / date of knowledge) in the matter, the case was issued and served and all Court directions thereafter were adhered to.
